  • Generally, it depends on what caused you to fall. For example, if you're clumsy and you tripped, they really have no obligation to you. If they failed to attend to a spill on their floor and you slipped on it, that's different. It also depends on what type of injuries you suffered as a result. If you just got a bruise or small cut, that is no reason to sue. If you had to get stitches or you broke a bone and incurred medical expenses, then you might have a valid case. Most grocery stores are used to this type of suit as are their insurers. If you honestly got hurt badly and you feel it was their negligence then send your complaint in writing (I suggest registered mail) to the store/district/regional manager with your medical bills. Hopefully, if you keep your tone civil and can substantiate your claim they will feel morally (if not legally) obligated to settle out of court and even offer a little something for "pain and suffering". I have, in fact, seen this happen more than once. Keep in mind that once you accept compensation, in most cases, that means you have settled your complaint with them. If they still refuse to pay for valid injuries or if you do not feel fully compensated by an offer to settle, then you should consult an attorney and see if they will pursue the matter on your behalf. And for crying out loud, don't get all sue happy and expect a big windfall from this (like the hot coffee at McDonald's case). That case was in and out of appeals for years beofore it was finally settled and no, the woman did not get $1,000,000. as she had asked for. I forget what the final disposition of that case was, but I believe she eventually got about $640,000 and had legal bills to pay. Laws are different everywhere and different situations exist in each case, so there is no one right answer to this question as is. Hope this helped though.
  • A grape fell on the floor and you slipped and fell. In the old days of Mom & Pop stores you got up and went about your business. In our ligitious society we figure the big global companies have big pockets and we can get a windfall. My dad did slip and fall in a major supermarket. He is not one to sue. He just got up and went about his business. He asked his attorney and family friend about sueing a large corporation. Is there something to these lawsuits? His attorney told him to forget it. The only people who profit are the lawyers. The major supermarkets have lawyers on retainer just to deal with these nuisance suits. We the consumer pay for this as a way of doing business for the corporations.
