No, he dont have to legally stay in your custody. Yes, the husband can still file for custody. he may have to take a blood test to legitmize him. But, the judge decides who will get custody. You and your husband should try to work something as far as child custody goes. Its cheaper and better if the two of you can come up with an agreement. I stay in Georgia and my cousin went thru a child custody case similiar, but she wasnt married.

Well, in 20 years, I have seen a case where this is an issue, but I certainly would teach the father how to get at least joint physical custody.

Look; the law of custody varies from state to state .... You need to get to a LEGAL office that deals in custody issues so you actually KNOW what to do ... and YOUR legal rights !
