You missed out some important information that will allow people to answer you. In particular: What country/state are you in? I believe that it is not legal to record someone without their consent unless you are given a warrant in most western contries.

Why would that be illegal? It's your spouse, and it's your own home. I don't live in alabama so i don't really know the laws there.

As far as I know, it's completely legal in any state to record someone, but you probably won't be able to use the recording for anything. Generally, such recordings would not be admissible in court, and guessing by the category this question is in, that’s where you want to use it.
