This is a gray area. Your employer must give you a copy of anything you signed. Also, in California you have a right to a copy of your employment file. You probably signed a form acknowledging receipt of the handbook. Thus, an argument could be made that the employment book is an extension of that signing, or that it is part of your employment file. Have you tried asking your employer for the handbook? You can also sue your employer (if you have a legitimate cause) and then subpoena the handbook.

I Believe that under the Fed laws an employer has 30 days to get you your handbook. Ck with your local US dept of labor. If you were fired for something that's in the handbook that you didn't get, like dress code, you should tell them, they may have you file a grievance against your former employer.
