  • In order to sue someone, they must have done something wrongful. Having control of finances and operations is not wrongful. Moreover, even if she does something wrongful, you may not be able to sue her directly. This is because she is an agent of the HOA. Thus, you would have to sue the HOA.
  • WHY would you ever get involved in such a thing anyway ? There are more homes without a HOA instead of those with one .... Ya' should have done your research on HOAs .... MORE problems for the members than you can shake a stick at ... Doesn't your HOA have a "Board" that overseas the President ... ? If not, they should have !! Just grab the ole phone book and find an attorney ... Be prepared to spend mucho $$$$ for this suit ... Personally; I'd send a certified letter to the President , addressing your specific concerns ... mentioning that you are "Considering" legal action IF immediate changes aren't forthcoming ...
