Speak with your JAG officer. He'll inform you of your rights and help you make whatever decisions you need to make.

Nope. If there are two parents in the same unit, they both get to go. There is no provision in the Army Regulations that allows one parent to stay behind. Military personnel with kids are *required* to have a family support plan on file with their commanding officer that describes who gets guardianship of the kids if they get deployed. It also has copies of powers of attorney, medical power of attorney, financial plans, contact numbers, etc.

they both go. You are going to have to sign custody of your kids to a parent or family

They both go, like those above have stated they are required to have a Family Care Plan in their files.

As far as the army goes they both go. As it was stated before. To be in the military as a dual military couple you have to have a family care plan in place. This decides who has the children and POA for any medical needs. If they were overseas they would have to also have a short term family care plan, so that if they had to leave before the long term could get here the children would still have the means of care. The family care plan also has an paper work for an allotment to be started and paper work to mke sure the children have dependant ID's to make sure the medical care is taken care of while the parents are on deployment.
