Absolutely. Any one married person can always file as married filing separately without the other person's permission and signature. She filed using her own income...and perhaps claiming the children, if any.

Yes and she probably filed for the years you both didn't pay income tax. She will have to pay penalty and interest but better to get it over with than let the interest accumulate. You may want to get straight with Uncle Same yourself. The longer you avoid it, the worse it will be.
