  • Actually yes! I don't know about all states but I live in Texas and the law is if their is no agreement yet and the child is in ones custody thy can keeo that child for as long as they feel the need or until legal action is taken and a custody aggrement is done. If sh thinks he is going to do this she dosn't have to hand her son over to him. He is in her custody so she can keep him. GOOD LUCK hope this helps.
  • Without any legal custody, your son can do this in most states; however, it can backfire rather badly. I suggest you consult legal counsel, as it can also be considered kidnapping. A verbal agreement to return a child is still a contract, the difference between a verbal contract and a written one is the ease with which you can prove it.
