  • Yes, lawyers can take payments. However, that is risky because there is little that a lawyer can do if you stop making payments. Unlike most service contracts, a lawyer cannot simply stop working once they accept your case. That is why they get a retainer up front. Of course, if your claim is only for $8000, why not go to small claims court? You will probably be capped at around $5000 (it varies by state), but you will pay more than that in attorneys fees if you hire a lawyer.
