In this case sighting how close to 18 she is you maybe able got get out of trouble based on that alone. its alkl circumstance really. as far as her lying and some one getting out of it cause the girl lied, it would be up to yuo to prove she lied.
  • You don't say what you are being charged with, but I will assume statutory rape. If this is the case, then intent does not matter. Statutory rape is one of the few strict liability crimes. Thus, if she was under the age of consent, you have committed a crime.
