  • I'm not a lawyer, so keep that in mind. But unless she has something in writing stating that the money she gave him was for the ring and that it is the collateral for the loan, I don't think she can. Think of it this way, if you finance a car the car is the collateral. Don't make payments and they take the car. But if you get an unsecured loan and buy a car and don't make the payments, they can't take the car because it is not collateral for the loan. This is what is sounds like is the situation here.
