your question is kind of vauge. If you fill out the proper paperwork (even after the fact) you must under fed law be given 12 weeks unpaid leave.

Whether it is an emergency or not is irrelevant. If you qualify for FMLA leave, you are entitled to it. If you do not, the fact that it is an emergency has no bearing.
