Do you have an attorney??? Do you have temporary orders in place? Where are you in the process of the divorce? Do you have kids? What state are you in? Need more info in order to give you thought-out responses.

if you could get confirmation of the extra money that he makes, then you could use that against him in court and get a more favorable financial judgment. just because he spends the money doesn't mean that you are not entitled to half. just as long as you get it in paper you could take it to court and a decision will be made on that amount, and not the amount he claims verbally that he still has left. if he sold his business go to the county clerks office and as his wife you should be able to get a copy of the selling price of his business, even if he closed it, most likely the judge will have him pay you 1/2 the amount of the business, even if he claims that he already spent the money. just because he might claims he has no money doesn't mean that you can't have a financial decision on your behalf. Once you get a financial decision, for alimony, 1/2 assets, child support, etc. you could get a lien and send a copy of the lien to the irs and state tax offices to get any refunds that he thinks he's gonna get, you could also use the lien to freeze bank accounts and get your money. PS: if the mortgage is in both your names, try to transfer it to your name and the deed to the property as well, he might have you pay the mortgage for now, and then try to claim 1/2 of the house. by all means, don't pay any credit card bills that are in is name, and if they are some credit card bills in both your names, remove him from them, because he could turn around get a new card and make charges that you will have to pay for to protect your credit.
