I don't believe they can permanetly confinscate personal property unless it is in violation of the law. Perhaps for the duration of the day and I think that the parent should be notified and given the rules of the classroom and then fined if the student disobeys the rules again. Cell phones are necessary items and can be sued by the parent for lack of this communication with the student "after school hours" A couple years ago... My son's teacher took his gameboy away and he told us that he lost it... Found out that the teacher took it away and told him he could never have it back. I went to the school and found out that the teacher had it stolen from his desk... I made the teacher pay for a new one. It was illegal for him to keep it overnight.

Have your parents go to the school. They should not be able to do this. The law varies from place to place, but they should not be allowed to confiscate personal property such as a cell phone. They are allowed to confiscate it for an amount of time, but your parents should have the right to get it back.

Every school district is different and have entirely different rules and regulations, concerning the conduct of students. Apparently, your conduct resulted in your cellphone being taken, as punishment. some schools do not allow cellphones in school, at all. other schools, allow cellphones, with strict guidlines on its useage. If you violated a school rule, your cellphone was probably taken, for a period of time, as pushishment. the school did not steal your cellphone. the school is just giving you and your cellphone a rest, along with a wake-up call to you, that you violated some school rule.

In Florida, students are allowed to have a cell phone on their person but it must be off and put away! If you lived in Florida and the school took you cell phone it means that you didn't have it put away. In Florida schools are allowed to confiscate (not keep) property that is consider disruptive. While I don't disagree with them taking your phone I think rather than keeping it for a week they should have called your parents in for a meeting. It also depends on the circumstances that they took your phone. Did you have it out in plain site or did the seacher your stuff and then take it. As far a families being able to contact their children while in school that's just ridiculace. If their is an emergency they can call the office and the office will get you out of class.

At my school, anything like a mobile gets conviscated until the parents pick em up, and things like knives, drugs, ciggies and alcohol, we get kicked out AND they get conviscated. If in the school rules it states that something is not allowed in school, they are well within their rights to take it

I say it violates the Fourth Amendment. Keep your phone on you and if someone tries to take it by force, get violent with them.

yes it is legal. If the student had it out in class than the school says that it is disrupting the class and may take away the phone for the remainder of the period, day, or couple of days depending on the school policy. It's unfair but it happens

i would say yes. if thier is a rule in the schoole about it then the child is breakong the rule and he/she should be disaplined.

They have the right to confiscate it, and to require that a parent or guardian pick it up. They don't have the right to take it permanently.
