  • depends on state law, for example i think (be worried im thinking) California law states that causing a fetus over a certain age to be mis-carried or terminated etc is classed as murder. im not fully sure on the technicalities of it all, but generally once a fetus is over a certain age it's considered a person.

  • This is the greatest debate of this sort and lot's of living people have been murdered on each side of the fence defending their positions. One can say no since technically it is not alive and it's life is solely dependent upon the mother and yes since it is sentient to a degree and that it acts autonomous on its own to some degrees.   • Yes. It should be noted that all states, historically, required that a baby be born alive in order for a person to be charged with murder. For example, if I punched a pregnant women in the stomach and she miscarried, that is not murder. However, if I punched the mother in the stomach, the baby was born alive, and then died, I could be charged with murder. The reason for this was because child birth was risky with a less than 50% survival rate. Today, this is no longer the case. Medical science is advanced enough that the likelihood of a child not being born is slim, and those that due miscarriage, we can diagnose abnormalities before it is born. So now, nearly every state has a law that allows for murder of a fetus.

  • That is the question! Legal minds are split. Religion often colors this question. But murder fall under the heading of civil rights. It is my civil right to live. If you take away my life you had deprived me of my civil right to life. So the question becomes - Does a fetus have civil rights? What about the civil rights of the living, breathing, working, thinking, voting, tax paying, mother? Does the right to life, liberty, and the pursuit of happiness pertain to her? Or is she just a vessel? If she loses her rights to make a choice for whatever reason, why doesn't the sperm donor lose his civil rights? (lest we forget...she didn't get pregnant by herself) Better paid minds than ours will deem themselves worthy to make these decisions. They go one way, and women remain fully functioning members of society. Choices can be made with the help of trained professionals. They go the other way and women go to back to going to back streets and filthy conditions to continue taking control of their own lives.
  • I watched my child, at 14 weeks gestation, wake, become agitated by the ultrasound, throw a tantrum and comfort herself by putting her thumb in her mouth. Can a fetus be murdered. Sure it can. There are alternative courses of action for those who cannot afford to raise their children. One of these is called adoption.
  • In Cal. several years ago Scott Peterson was convicted of murdering his pregnant wife,Lacy. Because she was pregnant at the time, he was also convicted of murdering her unborn child. So the answer is yes, Unless, of course it is done under the veil of "a woman's right to choose", then its perfectly legal, Huh?
  • Yes. If a woman is growing a fetus, and wishes it to become a child, then it is only fair that the fetus is considered another life form. However, the fetus is the woman's experiment, and she should be free to terminate whenever she so desires.
