  • They can't give a bad reference but often its what they don't say that speaks volumes!
  • I haven't heard of any law against giving a bad reference, only that many are afraid to for fear of being sued. However, since a bad employee can effect the new employer or the clients of the new employee so badly, I'd say that they need to be in fear of lawsuits from the new employer if they refuse to speak. That is how angel of death nurses move from one hospital to another. Meantime, as another poster said, just refusing to give a good reference is usually enough.
