No. if it came from the factory with a tailgate, it should have a tailgate, while being operated on the public roads.

It is against the law in Tennessee to have a full mouth of teeth, tail gate is optional.

This could be considered careless driving, if some object fell out of the bed of your truck and strikes another vehicle. the tailgate could have prevented this.
