I don't believe legally it affects custody rights, it may have an affect on the way a divorce is filed and the settlement of that. I would check with your state as laws vary greatly state to state

If that was the only mark against her and the father had none and both wanted custody, it very well could. At the very least, it shows that the parent is irresponsible. The father could even have the mother charged under old adultery laws in a lot of states.

leagaly i dont know what makes an unfit mother. as long as you provide food, shelter,attention,time for your kids also keep them clean show all your love to them.dont abuse of course i think my opinion ur fine. cheating on your husband has got nothing to do with you being a good or bad mother. very sensitive subject to me.. if i cheat its not with several different man. its with one and im very much in love with him now i didnt cheat just for the fun of it. After yrs of verbal and phsyical abuse, no love, no sex, no attention. after i stopped feeling like a woman a wonderful man came into my life who gave me all that and more that i needed.. im a wonderful mother i love my kids more then life..

It really should, I am going through that now. I was away getting med treatment for 3 months, got back just before Christmas only to find out that my wife had an affair with 2 or more men and a lot of phone sex and camming on the computer with numerous men. I haven't heard anything from my lawyer yet but I hope to put her through the ringer!

Not where I live and the father's adultery doesn't affect his custody rights either. Something to think about before anyone trashes mom's behaviour. Double standards - I hate 'em.

From what I saw on a show today, in order to bring adultery into a divorce hearing, you must have substantial proof. Like documented times, witnesses, places, video if possible... generally by hired professionals.
