  • Yes..the parent/guardian doesn't technically recieve payment..it is legally owed to the child..who ever has the child is to recieve the support for said child:)
  • I would say you would if child support had been awarded to the previous guardian (example: one of your daughters or daughters-in-law). If you aren't getting the support, where is it going since child support is generally paid to the court system. You might check the papers that provided you with legal guardianship of the child. Might even check with somebody for a little legal advise. The court system might be able to answer that question if they were to research your case. You would not need to go to court, just talk with the clerk of court.
  • yes. It is the parents legal obligation to support their children. Make sure paternity has been established. Were the parents married? Is he on the birth certificate? If not, blood tests would have to be done. If the mother is alive she is responsible also. If there is no court order, you will have to get a lawyer and petition the courts. If someone else is receiving child support meant for that child they are going to have to pay it back to the legal guardian, plus they may be criminally charged. I am not a lawyer and you should understand this when you read my answer. I am basing my answer on experiences with people who have gone through similar situations.
