  • It is not unlawful to 'date', only to have sex with someone legally too young to consent to having sex. The lawful age of consent differs by US state. If you date someone below the lawful age to consent you may be (even wrongly) accused of statutory rape (a crime). When an adult has sexual intercourse with a minor it is called statutory rape. Even if both parties agree to have sex, it is still statutory rape and a crime. So, even if you don't plan on having sex, just having a dating relationship with a minor may put you at risk for legal trouble from anyone observing your relationship that doesn't approve. You can find our the statute for your state by doing a search on statutory rape and the two character state abbreviation.
  • If you are "dating" someone under 18 without the consent of the parents its not unreasonable to think that you could be charged with kidnapping. Because kidnapping a minor has little to do with where the minor wants to be and more to do with where their parents allow them to be. More then likely though if its without consent of the parents they may use a restraining order rather then a kidnapping charge.
  • If the law is 16 then the other chould be charged with Statory Rape.
