If you mean any set of laws,which provide some protection for the average citizen, then the earliest ones we have are from the Fertile Crescent (Mesopotamia). 1)Sumerian king Urukagina of Lagashca c 2300 BC. I don't believe anyone used the term constitution to describe a politically organized body until the United States did. However, root of the word is the Latin verb for "to set up" so obviously the word and notion were in play in Roman times.
