  • Your ex sounds a bit confused... just because he takes you to court that doesn't mean he'll get custody of the child, far from it. Many separated couples go to court to work out visitation arrangements because they can't work the schedule out between themselves. If your ex wants to apply for custody, then he'll need to prove you're an unfit mother, basically that you can't look after the child properly. If the court says ''he should pick the baby up every other Saturday and bring him back on Saturday evening'', and you don't stick to that arrangement and your ex takes you back to court, then there will probably be problems. But unless there's a court order in place already, you're not breaking any laws and the court is highly unlikely to do anything except impose a formal visitation schedule.
