  • It's a good idea to push very hard for permission. however, what you're using it for changes that a bit - if it's a school project, it shouldn't be a problem as long as you reference the picture and artist properly, and don't try to claim it as your own. However, if you start printing it on t-shirts and selling them, or start using them as a company logo, you're gonna get into heaps of trouble - legal trouble.
  • If you use the image without getting permission you are violating the owners copyright. If you sent the owner an email asking permission, you have now put her on notice to look for your infringing site. However, whether or not she will actually sue you is up to her. The only time you can use someone else's copyrighted work without permission is if your use is related to your first amendment freedom of speech. For example, if you wanted to publish an article criticizing the picture, you could use the picture if it was necessary for your criticism. This is called "fair use."
