  • i don't think so. i think it is only legal in that state that it took place in or other state that up for the gay marriage law.
  • No, not at this time. It's only legal within the states it's been legalized (which at this time, is only 2). If we all get out there and vote and continue to work on getting these laws changed, one day soon we'll all be able to legally marry anywhere in this country.
  • If a same sex couple marries in California, their marriage will only be recognized in the states of California, Massachusetts, and New York. Massachusetts has recognized legal same sex marriages since May 2004 and same sex marriages from other states where they are legally performed since July 2008. New York, which doesn't recognize same sex marriage within its own borders, has recognized same sex marriages from other states where they are legally performed since May 2008. Same sex marriages are not recognized by the federal government due to the Defense of Marriage Act of 1996.
  • Your question was: If someone gets married in CA now as a gay/lesbian and moves to a different state, would the marriage benefits still apply in those states? So basically if you get married now in California and move to Washington state, would that person still be legaly married? Yes. If you're a gay/lesbian, you can still get married in California, or any other state (provided that you're at least 18). None of the 50 states discriminate on sexual orientation - they don't ask or care what sexual orientation a person is when they get married. All 50 states allow adults to marry, regardless of sexual orientation. States allow any and all adults to get married, but reserve the right who you can marry. They don't allow adults to marry 2 or more other adults, or allow adults to marry children, or allow adults to marry close family members, or allow adults to marry same gender. So if one now gets legally married in California (by definition a man to a woman), then you'd still be considered legally married in any other state.
