Regardless of how current that news is, that's been the case since long before the 2004 election. Yes, Obama can reverse it and employ it against Bush & Cheney simply via the same "executive privilege" Bush-Cheney have been abusing. To get rid of the Patriot Act, he needs a majority of real Democrats in the House and Senate, not the butt sniffing party-changers like Lieberman and Coleman.
