I don't know about on an airplane but in some states it is legal to record a phone conversation as long as one party to the conversation knows it is being recorded. Now whether that would pertain to 'air space' or not, I don't know. Before I did any recording I would possibly check with an attorney or some other legal advisor.

Most likely. Although your question raises an interesting question that I would have to research to give you a definitive answer. First, laws vary by state on this issue, but the activities on an airplane are highly regulated by the federal government. Thus, the answer could depend on what state you were flying over at the time of the recording. Or it could be preempted by federal law. Also, what court you are in would make a difference as well. (This is that issue I would have to research). Despite all of the above, I say most likely because even in states in which consent of both parties are needed to record a conversation, usually that only applies when you have an expectation of privacy. Therefore, unless you were on a private plane, it is unlikely you had an expectation of privacy. Also, your question indicates a lack of consent, but not alack of knowledge. If the person knew they were being recorded, in some states it does not matter if they consent or not.
