i know this is long, but here are the west virginia age of consent laws. In West Virginia, the age of consent is 16 for heterosexual acts and 18 for homosexual acts. This includes both men and women. This is the age at which someone may legally consent to sex with an adult partner. The law is slightly different if the older person holds a position of trust and authority over the younger person, such as a coach, a teacher or a minister. In those cases, the age of consent may well be 18 years old or even 21 years of age. As in other states, the West Virginia age of consent laws were designed to prevent sexual exploitation of young people by adults. They were not created to persecute teens who enter into consensual relationships with their peers. Under West Virginia law, 11 year olds may legally consent to sex with a partner who is under the age of 14. In general, it is legal for people as young as 12 to consent to sex with a partner who is no more than 4 years older. So, for example, a 14-year-old girl could consent to sex with her 17-year-old boyfriend, but not someone who was 19 years old or older. Under West Virginia law, third-degree sexual assault occurs when a person aged 16 years or older has sexual intercourse with a person under the age of 16, if the offender is at least 4 years older than the victim is. This crime carries a sentence of 1 to 5 years in prison.

I believe it is of the upper age limit. The law changed recently to stop it becoming compulsory for 12 year olds to have sex with a relative.
