The police are faced with this situation many times daily. do some officers go overboard on car searches? yes. the police must have probable cause or a reason to do what they do. if the odor of alcohol was coming from inside this vehicle, that would be probable cause to investigate furter, especially if a minor is in the vehicle. Many people do not realize that they have a right to say no to the police for a vehicle search. most innocent people would not object. if a person objects and the officer has strong probable cause to believe their is contraband or fruits of a crime inside the trunk, the officer will seek a search warrant. this normally takes about two hours. remember O.J. Simpson? the police should have secured the area and signed a search warrant, instead of jumping over a wall. the evidence was not going anywhere and a search warrant would have looked so much better in court. Anyway, you have a right to say no to an auto search. saying no to an officer, means you have something to hide and in most cases, you do.
