No, a policeman has no right to search your vehicle unless he has strong grounds to believe a crime is/has being/been committed.

A cop can search a car whenever he has reasonable suspicion that a crime is being committed. Thus, if having a minor in the car was a crime, then yes.

Have you ever been in a situation where you just believed that something was wrong? a gut feeling?

The police are faced with this situation many times daily. do some officers go overboard on car searches? yes. the police must have probable cause or a reason to do what they do. if the odor of alcohol was coming from inside this vehicle, that would be probable cause to investigate furter, especially if a minor is in the vehicle.

Many people do not realize that they have a right to say no to the police for a vehicle search. most innocent people would not object. if a person objects and the officer has strong probable cause to believe their is contraband or fruits of a crime inside the trunk, the officer will seek a search warrant. this normally takes about two hours. remember O.J. Simpson? the police should have secured the area and signed a search warrant, instead of jumping over a wall. the evidence was not going anywhere and a search warrant would have looked so much better in court.

Anyway, you have a right to say no to an auto search. saying no to an officer, means you have something to hide and in most cases, you do.

cops regularly get away with everything from speeding and using the siren to run red lights(not going to a crime, just don't want to wait)to beating, tasering and even murdering people. is it legal? no, but with the "Blue shield they are protected. the police are just another street gang, they got each others backs no matter what.
