  • You can file for temporary support. It may or may not be granted. I had a friend in this same situation, and she was granted temporary support in CA. If the home and mortgage are in both partys' names, then you should be granted temporary support. Temporary support will be in place until a full divorce settlement has been reached or ordered. Some states have amended their laws based upon just this type of situation, although my specific knowledge has to do with child support. However, in many states now, child support is calculated based upon you potential earnings, not your current ones. So if you made $100,000 one year and $25,000 the next, your child support is calculated based upon the $100,000 (barring extenuating circumstances). Don't let people like the one who posted the other answer get you down. These people have emotional baggage that they are bringing to the table that has NOTHING whatsoever to do with you.   • You are no longer married. I can see from Gracin's downrated answer that this is not an acceptable answer to some people...You divorced your husband. Get a new job and move on with your life. Unless you have children together, he shouldn't give you anything as long as he is paying HIS half. You are responsible for your half.
  • Go get a lawer,and make him pay temporary support.If you are not working and have no money then file for welfare and food stamps.You may be intitled to allamony,get someone to house share with you so you dont lose your house.If he has abandon you for no reason and is out of the house then,they might give you the house free and clear,since you are the one left in the house.If you have to give him half,then save all receits that it has cost you for any repairs or expences that you put out and deduct it from the his share,after the house is sold.....BUT GET A LAWYER RIGHT AWAY,,,,,DONT LOOSE YOUR RIGHTS!
  • Being LATE will not cause you to loose your home. If you do not pay at all...for three months THEN the mortgage company will do one of two things. Either contact you to see if there is anything they can do such as redoing your current mortgage, (if you have an ARM that just hit and jacked up the price)... or Start the papers to foreclose...after 3 or even 4 months of NO payments. At this time, very few lenders want to foreclose, if they can avoid it...they already HAVE too many houses because of the current situation. If you are constantly late paying bills, it can effect your CREDIT SCORE...and on any your husband is also listed on...his score too. Speak to your Attorney about this problem. He/she NEEDS to be aware of it if your husband expects to gain any part of the house, in the divorce.
