It would be a misrepresentation of the companies legal status to have "Inc.", or "Corporation" as a part of the name without being registered formally as a corporation somewhere.

Not necessarily. It would have to be actually file the "Articles of incorporation" in the state it is operating in to be be legally considered a corporation. Now, most likely, the businesses that have "corporation" or "Inc" or "incorporated" are generally actual corporations. But just because somebody decides to put it in the name of their business doesn't mean it's legitimate.
