I think this is the case myself. It seems that this rule often stands in the way of legal innovation. Just my thoughts.

A legal system depends upon standards, not an atmosphere of 'innovation'. If the law were able to be manipulated and interpreted differently in every case, anyone who could come up with a good excuse would get off. Violent offenders who were able to rationalize and blame their victims effectively would be found innocent. No prosecuting attorney or attorney general would be able to present supportive case law regarding the legal reasoning already established, and would have to go through the entire reasoning process time and time again, wasting everybody's time and the tax payers money just to determine what had already been determined perhaps many times over. No, there is a reason for the rule of precident, and it has nothing to do with the legal systems atmosphere, and everything to do with the reasons presented above.
