I have my home on the market and we have signed a purchase & sale agreement, but the sale is contigent on the buyer selling her home. We have changed our mind and want to take it off ... can we legally cancel the P&S agreement?

    Does your buyer have a contract on their home? How long ago did you sign the contract? Did the buyers do their home inspections yet?

    No, we don't have an attorney. We do have a 48 hour kick-out clause.

    I'm in NJ. Not sure of your state. Did you use an attorney? I would ask your attorney if you did.Do you have a kickout clause for the contingentcy?
