First: Did your personal insurance help you recieve the claim from the other drivers carrier? If so they contact your insurance and have them do the leg work. Second: If you only went through her insurance then you need to contact the person who was incharge of the claim. They can tell you if you have any presidence. Usually if you have alread recieved a settlement check for the original accident then by cashing it you pretty much saying your not pressing further with any more claims. Third: If that is the case your only other option is to sue the individual. Its very possible youw will win if it was only a few months ago but if its been over a year then it may be hard to prove that your knee problems spawned from the accident when no medical attention was brought to it at the time of the claim.

depends what state you live in. For the west coast: AK, WA, CA, OR, ID, UT all have 3 year statutes of limitations on bodily injury. AZ and MT are 2 years. i dont know if you live east of there you'll have to check the SOL. go to a dr. find out if the dr thinks its related to the loss. also did you ever claim for the floating knee? if you claimed the knee in 2007 and got a "first call settlement" you are not entitled to claim again, you signed a release.
