I don't know which State you are in, some states foreclosures take place on the court house steps the morning of the first Tuesday every month. This is the thing, do not waste time on this same attorney, go to another while you still own you home. People are generally allowed to file a Chapter 13 and keep their home, so long as they can prove that they can afford to pay the monthly payment, not all the late fees etc, once in a Chapter 13 you can usually go back seeking protection up to 3 times down the road. If you contact another lawyer now, take in your W2's they will know if it should fly or not. I am assuming you have talked with your lender and they aren't offering you an agreement like forbearance ?

Some have no choice but to walk away from mortgages. Are they allowed to pay the money they owed years later when they can afford it?
