Yes, he can fake the throw to third, and it is done quite often. But his foot must be off the rubber or both runners will be allowed to advance.

His pivot foot can still be on the rubber when he fakes the throw to third, but he must step off to make the throw to first. Also, a left handed pitcher cannot make a similar move since you are not allowed to fake the throw to first.

In games played under the Official Rules of Baseball, the pitcher can fake to third in contact with the rubber, but must break contact before or as he turned to throw or fake to first. In high school rules he does not have to break contact in this situation.
