Amendments can only be a part of the Constitution when approved according to the process in Article V of the Constitution. The final deadline for approving the ERA passed in either 1979 or 1982—depending upon one's view of a controversial extension of the ratification time constraint. In the intervening years, public discussion on the ERA has been greatly reduced, though the proposal has been reintroduced in every Congress since 1982.

There is no ERA amendment, but the 14th Amendment allows for equal protection of all peoples under the law.

In addition to Equal Protection, the 14th also guarantees everyone the same Privileges and Immunities under law, which does get at the equal rights shared between people.
