Is it legal for a judge to award my 401(k) retirement funds to my former spouse to pay for back spousal support?

  • That depends on the laws in the juridiction where you live. If a debt is owed and is not paid, a judge can order that assets are seized or liquidated to pay the outstanding debt. Typically, judges are not this aggressive unless the payment is for child support or there are other extenuating circumstances. Again, depends entirely on the laws governing where you live.
