  • Talk to the apartment management first about it. If they're not helpful to your wants and needs, then talk to a lawyer. Or at least threaten the apartment complex with a lawsuit, that will get them to want you out of their hair. :)
  • You might have to go to court to break the lease. You will have to do your homework to show that the "quiet enjoyment" is not being maintained. This is done by getting copies of police reports for the property in question and letters from neighbors might help also.
  • just break your lease, and move out. Most times the fine/fee you pay for breaking the lease is less than court costs and much quicker. Check your lease and see if there is a clause for breaking the lease and fees associated with it. If there is nothing in your lease agreement about it then you can technically break your lease with no penalty
  • Move out NOW!! Do not stop at “GO”! Do not get involved in senseless dialogue with the landlord! The terms of the lease have been broken or unfulfilled. Why? BECAUSE there is an implied covenant in every lease or rental agreement that the premises will be suitable for the purpose for which they were let. Living in the crossfire of a shooting war does not meet any accepted standard of suitability! Just be able to document the events you describe – a personal diary, police reports, newspaper reports, statements from neighbors, etc. Sax (I apologize if there are some duplication with this response.
