I am assuming that there is a will, which has to be dealt with in probate. I would contact the court which is dealing with the will and address the matter. Usually they post in the local paper about a death and any creditors or anyone who has any claim to the estate has so many days to respond to the posting.

Thank you Misty!!! My Problem is that my Friend Died in Michigan, so nobody called to tell me that my Friend died. Didn't find out until 3 weeks Later. I'm in South Carolina so I never saw a Michigan Paper. I would like to put a Lien on his Property here in Sc. but don't know how to do this. I'm from Germany without Fam. and live on a fixed Income, so the Money matters.. Again Thank you Misty..Gucci

Do you know if the decedent died testate (with a will) or intestate (without a will)? Do you know if a will has been filed with a probate court and an estate opened? If an estate exists, you may have to make a claim in accordance with applicable law. If the personal representative (executor) rejects your claim, you may have to sue the estate. It is possible that there are no assets to fund the estate or the estate could be insolvent. It is possible that the decedent's assets (real property; bank accounts, etc.) were transferred to his sons via nonprobate transfers before or upon death and those assets would not be included in the estate. In that regard, you would have to discover whether the nonprobate transfers took place in order to defraud creditors. What you may or may not do to collect the debt depends on all the facts and circumstances involved and the laws of the state that has jurisdiction in the matter. You should consult a local attorney.

You can get online and find out if the will has been probated. You must find out the county in Michigan that his city is in. For example if it is Huron county you look up Huron County Probate Court and go from there. Also, if you want to sue someone in another state, I believe you need to hire a lawyer in that state.

Hi Debra.. I loaned my Friend the Money Because he had very high credit card ecct to pay. I had yust sold my Home and my Bank only payed 3/1 on the Interest. We had a contract say he 'would pay me 6%., back and he did every months until he Died.{ his credit cards were around 21% I'm a Widow with no Fam.and the Returned money was a little extra on my fixed Income...I guess I messed everything up,I'm 65 years old and have to say ::A FOOL NEVER LEARNS:: My friend died very unexepted in Michigan[ as i said before, I'm in South carolina] nobody let me know of his dead until another Friend found out about it..$16.400 it's a lot of money to me,and Ill try to talk to a Lawyer but I yust don't have a lot of money to pay a Lawyer a lot. his Sons are all grown with Fam. and all of them makeing great moneys. So for them to pay me back would'nt be a heartship but it'll be for me. A friend told me yesterday that there 'll action the property off in 2 weeks..
