It depends on where you live. I had similar damage to a tire and rim and was reimbursed for both items by the state department of transportation responsible for road repairs.

Yes. i make damage to property reports everyday for just this type situation. call the police. an officer will come out and make a report. Be sure to take a photo of the pothole, in case you have to hire an attorney. the photo is good evidence in court. also. a photo of the damage to your automobile and the license plate number and date.
