I live in SW VA and travel I-81 on a daily basis. I drive in the passing lane all the time and have never been ticketed. I do this because I-81 needs to be wider (more lanes) and since there are no plans to do this in the near future, when I 10 miles from the Roanoke Airport exit, which is a left handed exit, I get in the passing lane. With the traffic entering the Interstate from the Truck Stop area and the 18-wheeler's needing access to the scales (on & off) to the construction at the Hollins exit - I have no choice or face the possibility of missing my exit.

There is no law in Virginia regarding this. Some states have created laws on this but VA is not one of them. Now if you are driving under the speed limit in the passing lane then you could possibly be summonsed (ticketed) with impeding the flow of traffic but that is it.
