Yes. In answer to the biblical question "Am I my brothers keeper", I think the answer is "Not keeper, but carer". We all have a duty to care about each other, and most particularly about children. From the sound of it, this was not minor injuries, this was severe harm. And we all have a duty to prevent such harm recurring, as it probably would. So yes, the day care worker deserves some significant punishment to make it clear that s/he had grossly failed in her normal human duty.

There are several professions that are legally required to report abuse. Child care is one of them. Doctor's/nurses, mental health workers, police officers, school instructional personel ect. If these people do not report abuse they can loose their license if they have one as well as face charges.
