That's a possibility in many jurisdictions and fact in many more. Here in Ontario, for example it's fact. The home owner is responsible. A pal of mine was sued successfully because his wife's cousin decided to booze it up ( not even the home owner's booze) and drove home, veering off the road and only injuring themselves. Wife's cousin won a 140 thousand dollar suit.

Yes... I hope that your question is rhetorical. If not, I am sorry. It's best to provide taxi service, or have folks sleep over if you are going to have a party. It's unfortunate, but we live in a society where some dumbass can be awarded a couple million bucks for spilling hot coffee in her lap.

I dont understand why you should be liable...im no solicitor but you didnt force the alchol down the persons throat did you and I take it the person was of legal age to drink?

Not a lawyer. This question depends on whether or not negligence can be proved. If you got this person drunk on purpose, that is murder. If this person got drunk on their own volition and you made little to no effort to get their keys away from them that is a form of negligence. If you saw this person going green in the face and still imbibing alcohol but chose not to take action and alert the appropriate medical facilities, that can be construed as negligent homicide. You can be sued for a number of things if it can be proved that you knew that excessive alcohol was being consumed in your household. This is why hosting alcohol parties in a private residence should have ground rules and disinvite any of the known boozehounds. If you are afraid of having a suit filed against you, I suggest you have a straight story as to your involvement with the deceased, your interactions with them on the evening in question, and your ignorance to the law and your common law responsibilities. In this way, your suit may be dismissed by a sympathetic judge or at the very least your penalty commuted.

actually, i think you can be...whether or not you would go to jail, i doubt that..but maybe sued.

Yes, you can possibly even go to jail for it. You are responsible for everyone who attends a party you throw and to make sure the don't drive intoxicated. You must call a cab. If the person refuses the cab, then I believe that you do not hold any more responsibility. *********** I used to be a bartender and know that I was responsible for the intoxication of all my customers. I was also hit by a woman driving at .21bac and found out after that I could have sued the person who owned the house she was leaving.

that is why so many companies dont serve alcohol at parties anymore.i do not agree with it but...if a person is dumb enough to get behind the wheel after drinking its their own fault.
