  • In Massachusetts gays can marry but only if they are state residents. There are also states in which gays and lesbians can get civil unions, which allow for some of the same rights as married couples without using the term marriage. Connecticut (only available to same-sex couples.) Vermont New Jersey California (only valid in California) Hawaii offers reciprocal beneficiary rights to same-sex couples. Some of the rights granted are: inheritance without a will, ability to sue for the wrongful death, hospital visitation and health care decisions. Maine - The law mostly benefits couples if one dies: inheritance without a will, the right to make funeral arrangements and the ability to be named guardian if partner becomes incapacitated. Washington State (limited legal rights) New Hampshire (effective January 2008.) Oregon passed a domestic partnership law, but groups opposing it are attempting to collect signatures to put the issue up for a vote on the January 2008 ballot.
  • Same Sex Marriage is only legal in Massachusetts, and that is only recognized by the state and not the federal government. Civil Unions (legal recognition with most marriage rights) are recognized by Vermont, Connecticut, New Jersey, & New Hampshire (Oregon passed a Civil Union law that has yet to take effect due to legal action). Domestic Partnerships (legal recognition lacking some marriage rights) are recognized in California, Hawaii, Maine, Washington, and the District of Columbia.
