  • Entrapment requires that an officer put the idea in your head to commit the crime. The fake hooker is not doing anything that would put the idea in your head. If it was a real hooker you would still do the same thing.
  • It's not a scam, it's a simple legal issue of intent. If the "John" offers money for sex, a crime is being commited. However if the "john" asks the "jane" if she is a police officer, she has to answer truthfully and the "john" can walk as long as no monitary exchange is discussed.
  • Well, it basically comes down to who says "sex" first. If the "Hooker" says she'll give you oral for twenty-five bucks, that's Entrapment; but if the John asks "how much for a BJ?", that's Soliciting a Prostitute.   • Actually a police officer does not have to disclose their identity, even if you ask,they can say no. If you discuss sex with anyone who you pick up,its a crime to ask for sex from a stranger. Thats how they get you. Dont discuss sex, ask the girl would you like to go out go back with me to my hotel, the cop wont go back to a hotel.
  • Law enforcement can use entrapment however it is illegal for a regular joe to use it as it invades all sorts of laws.
  • It is legal because the undercover cop / hooker does not offer sex. The john asks the hooker for sex and that is illegal solicitation for sex. If the undercover asked guys, "Hey would you like to give me $25 for some sex?" then that would be entrapment. You have to let the criminal commit the crime on his own. You cannot persuade him to commit it. And as others have said, an undercover cop does NOT need to tell you if they are a cop. They can sell you drugs, hang out with you, and promise you that they are not a cop and it is still legitimate. A police officer is under no obligation to disclose their identity.
  • The Johns are already out there and nobody put the idea in their heads to commit a crime; therefore, there is no illegal entrapment involved. Legally, the cops have to do something about all the complaints from citizens to clean up their neighborhood. The fake hooker/real cop scenario will scare the real hookers away from the area and the cops will have done their jobs by making the streets cleaner for the citizens.
