The road is owned by the state of Georgia. But if you want to know who is liable, most likely the other car. On coming traffic has to yield to the cars already on the road. I say most likely because if you changed lanes without signaling, or after the other car has entered the roadway, you could be liable.

You do. I assume the side road had a stop sign? If you were in a legal passing zone, no double yellow line for you to cross over, then you have the right of way. The other driver is guilty of yielding the right of way. The automobile that is already occupying a lane, has the right of way. many people do not understand this, especially when it comes to turning lanes.

You. Especially if there was a stop or yield. From experience, I can tell you that the insurance won't settle in your favor, though because apparently it's hard to get money from yahoos (as in stupid people, not the search engine). Something similar happened to me last year, totally unfair. It was ruled as my fault--when it was clearly his--because he was driving a borrowed, uninsured vehicle.
