  • Under federal law and employer must only pay overtime if you work over 40 hours in a week, and federal law does not require a meal break be given. Thus, everyone's calculation of $312 ($39 x 8) is correct. However, many states require that a person be given at least a 30 minute meal break if they work over 5 hours in a day, and some states require overtime if you work over 8 hours in a day. Thus, if you are required to get overtime for 8 hours, and not required to have breaks, your pay would be $312 plus time and a half for the last hour of work on Thurs & Fri. Thus, your pay would $320 ($8x39 + $4x2). The break issue is more complicated. Some of the states allow an employer to require employees to work through their break (as long as they can eat on the job), but usually they have to pay you for an extra hour of work. If this is the case in your state, you would get an extra $40 ($8 x 5). Other states just say it is illegal to not give you a break, and if you sue you are entitled to triple damages. However, this will not affect payroll.
