There is no doubt texts can be preserved and publicized even years later. Just google Kwame Kilpatrick text scandal and see what pops up. The bottom line is never write in an IM, email or text message anything you wouldn't want to see published.

Yes, the capability is definitely there, hardware & software wise, but because of privacy issues, they are SUPPOSED to get either permission or a court order first ... ... of course, laws vary world wide, so getting into the system to do the actual viewing differs from country to country ...
