Two reasons. First, the toys don't contain GHB. Rather, they are made from a GBL derivative that turns into GHB once metabolized. Second, even if there was GHB in the toys, there is no mens rea in the parties you cited. GBL (or gamma butyrolactone) is only illegal when used for an illicit purpose. GBL is commonly used as a degreasing agent and can be legally purchased in America.
None of those people KNOWINGLY possessed a drug. They had no reason to suspect that GHB was in the dots. Also, as someone else mentioned the dots have to be ingested and chemically altered in the stomach to turn into GHB.
If would be like someone mixing cocaine into your sidewalk chalk and not telling you. The police wouldn't arrest you unless they had reason to suspect you were aware they contained cocaine. Even if they did arrest you it would only be an attempt to go after the person who initially mixed in the substance.
I agree 100%! If people would take their stand with the way the government runs things, our country would be such a wonderful place to live!

The chemical that aqua dots contain is 1,4 butanediol. It is sometimes used in the making of plasics. Somebody discovered that when the chemical is consumed, the liver converts it in to GHB. 1,4 butanediol is not illegal, but the supplier of the chemical would probably ask you why you want it, and proof that your using it to make plasic.

You're reading If those "AQUA DOTS" have the illegal drug "GHB" in them, why doesn't the almighty federal government criminally charge EVERY store clerk, manager, distributor, warehouse manager, corporate types, manufactorer types, etc for possession and distrubution?

Good answer but no cookie. Your facts are correct but you forget that the government doesn't care that it's not yet the complete degree of illegal substance, only that it can be turned INTO" the "controlled substance" in violation of the failed drug policy which is turning average everday citizens into political prisoners every year. Consider this: You go to town shopping at various stores and buy the following 100% legal items almost every grocery store sells: 1. Drain cleaner ( your sink is stopped) 2. Sinus medicine ( your nose is clogged) and 3. Starting fluid (your having trouble starting the lawn mower) YOU CAN BE CHARGED WITH MANUFACTORING OF METH IN SOME STATES AND GET UP TO 15 YEARS!!! This is no joke folks! So what the question was about was the double standard. Rich business people get away with these things, poor people go to jail due to this unfair, lopsided, failing drug policy which is only getting worse. You are right if you buy (and the state can prove beyond a reasonable doubt) that you purchased the items with the intent to manufacture. Certainly if you purchased Aqua Dots with the intent of producing GHB, you have committed a crime. However, the questions talks about toy suppliers and distributer who are selling Agua Dots because they are in the business of selling toys. But point taken.

Good for a cookie and a point. Thanks for the clarification. It a sad day but it's a lot easier than most people thing to get into trouble, especially when it's mostly discretionary.
