Restaurant- 1 diner orders breakfast meal, other order dinner. No biscuits and muffins arrive. Diners asks for some, is told "not supposed to bring with breakfast". Waitress brings anyway. Should dinner person be penalized cause other diner got breakfast?

No - your server was just lazy. Biscuits, etc., should have been brought and placed by the person ordering dinner. Had she told me that, I would have nicely pointed out that I ordered dinner, which comes with biscuits and muffins.
